Hpyothetical Design Brief

Company profile
Pest skateboards is a skatebaorder run company founded in sydney in 2010. Our main aim at Pest is to create quality skateboards at an affordable price. Until now we have only stocked blank un-branded items disreagrding apparel. The company has an “underground” following in the sydney skate scene. We are looking to expand and market our products all over Australia.

Target Audience
Our main target audience comprises of:
-       Males aged between 12-19; these are our main consumers and the heart of our business. They seek a trendy product though our aim is to produce and sell this at a lesser cost.
-       Females aged between 14-18; they make up a small portion of our sales. They tend not to consume skateboards but more the branded clothing.
-       Skaters a loyal to brands they know and trust, we are looking to produce this bond with the consumer and create long term customers.
Work Required
Project overview: Pest skatebaords at this point does not have a consistant logo, we are asking you to design a company logo that fits our company and appeals to our target markets and street culture. Following the creation of the logo we would also like a design for a set of wheels and a skateboard containing our logo.

Logo: We would like a logo that represents where our company started, skateing streets. We are not aiming for something corperate or a masgot. It will have to appeal to our customer base and well something we thing is cool.

Skateboard: You will be designing a skateboard with our logo, it will be printed to a 7.75 x 32inch maple deck.The colouring in not important, you can be as creative providing the logo is visable. Decks will retail for $79.95.

Wheels: We would like the design of the wheels to be matching the design of the skateboard forming a set. The wheels will be printed onto a polyurethaine wheel of 52mm.

E.g

Time and Budget
- We are giving you 2 weeks to product the company logo for approval before the design of the deck and wheels begin.
- Upon approval of the logo design we will give you a further 4 weeks to design the deck and wheels.
- Pest skatebaords is an emerging business as such we have a limited budget though we think the tasks can be met within the time frame keeping costs to those estimated.
Goals
- The goal of creating a logo is to gain brand awareness through out Australia and have people recognise our products on sight. This hopefully in turn will raise our customer base and profit margin.
- In creating our signature line deck and wheels we are seeking to gain entice youth to purchase our product over competitors as before this we only sold blank items. Eventually we are seeking to gain stockist throughout australia.

EvaluationSuccess will be measured in sales and end of year profit. We are also gauging success by the credibility our brand has received from our new design and the exposure received during competitive skating.

Exclusion From CopyRight

Copy right law Australia

In Australia it is illegal to use the ideas and creations of another as your own. There are many laws preventing this; however there are exceptions to these laws. The Copyright Act 1968 allows others to use copyrighted material in certain circumstances these include:

Fair Dealing: If you wish to use copyrighted material in a way that is reserved for the owner you will generally need permission from the owner however this does not apply is the copy right has expired and or you are using only a less than substantial part of the material, i.e. quotes and extracts. There is no general exception from copy right law just because you thing it is fair or because you are not making a profit from the material. You are however allowed to use copyrighted material for these purposes;
-Study/research: If you use what is deemed less than a certain amount of the content for study or research it is included as fair. If this amount is exceeded the Copy right act plays out a number of factors that are to be taken into account to determine if you are actually using the material for research or just reproducing said material.
-Criticism or review: People can use copy written material for purpose of criticism or review as long as they recognise the author or creator providing the deal is fair. For it to be included as criticism the material is to be judge and or its underlying themes as defined by Supreme Court. For this to be a strong defence in court the criticism or review must have specific purpose and be genuine.
-Parody or Satire: The terms parody and satire are not defined in the copyright act and are yet to be considered by Australian courts though the dictionary meanings of the word will more than likely be taken into account. A parody is a comic reproduction of the material which may contain parts of the original. The purpose of a parody is usually to make some comment about the material or its creator; it may also be specifically for comedic purpose. The purpose of a satire is to make light or poke fun at a material or its creator. It is used to draw attention to characteristics and actions of a material using sarcasm, irony and ridicule. This does not affect the owner’s right to pursue legal action if his or her content is used in a derogatory way. Main legal matters affecting this include: How much content is used, the context in which the parody is used and whether or not the owner of the copy right allows such uses.
-Reporting or News: A material may be used in reporting media as long as the author or creator is acknowledged. Federal court ruled that news is not subject to just current events, older material may still be used in a broadcast without breaking legislation.
-Professional advice by lawyer or attorney

If in the unfortunate event of a court case arising defence and prosecution always comes down to circumstances of the case. Courts generally look to see if the person in question is using the copyrighted content in such a way that is set out in the copyright acts i.e. is using content for study and research use. Also if the owner of the copy right is out of pocket directly from the effects of the use of the copy right it will greatly affect the outcome of the case.

Design Pathways

The design industry has a wide variety of pathways;
- Industrial & Comercial Design, from altering and designing every day products all the way up to medical equiptment and warehousing. It is one of the most diverse design pathways, it also takes more than a designer to be functional. Designers in this field work with architects, engineers, material scientists and the manufacturer.
-Floral Design, Designing floral arrangements. This application of design takes less computer skills and more of a hands on, green thumb approach.
-Interior Design, Designing basically anything inside a building which incorperates colors, textures, furniture, lighting, space and working together to meet the needs of a building's occupants. Designers mostly work in small firms or self employed, interior designers can be contracted by the government to design the interior of airports, hospitals and other government buildings.
-Fashion Design, Fashion design incorperates research of trend, vast knowledge of industry and applications of textiles and fabrics as well as creative design. It is very hard to break through into this industry as an  independant designer. Most designers work in wholesale for basic items such as tee shirts, everyday footing and alike. This is one of the higest paying sections of the industry.
-Graphic Design, Graphic designers are a link between a producer and consumer. They communicate a business goals through signage or advertisement using  color, type, illustration, photography, animation, and various print and layout techniques. There are many considerations for this type of design most revolve around consumer trends and business goals.
